This Disclaimer applies to the website at mjeservices.com.au (the “Website”), including any AI chatbot or automated assistant made available on the Website (the “Chatbot”). By accessing or using the Website or the Chatbot, you acknowledge and agree to this Disclaimer. If you do not agree, please do not use the Website or the Chatbot.
In this Disclaimer, “we”, “us” and “our” mean Tax7 T04 Pty Ltd trading as MJE Business Services. “You” and “your” mean any person who accesses or uses the Website or the Chatbot.
1. General information only -- not personal advice
All content on the Website and all responses from the Chatbot are provided for general information purposes only. They do not constitute, and must not be relied on as, personal taxation, accounting, financial, superannuation, legal or other professional advice.
The content does not take into account your particular objectives, financial situation, circumstances or needs. Taxation and accounting outcomes depend heavily on each person’s individual facts and circumstances, and general information that is correct for one person may be incorrect, incomplete or inappropriate for you.
Before acting, or refraining from acting, on anything contained on the Website or provided by the Chatbot, you should obtain advice that is specific to your own circumstances from a registered tax agent, qualified accountant or other appropriate professional, and you should enter into a formal written engagement with us (or another adviser) for that advice.
2. No advice and no engagement relationship is created by the Website or Chatbot
Accessing the Website, reading its content, using the Chatbot, submitting an enquiry, or otherwise communicating with us through the Website does not create a client, advisory, retainer, agency or engagement relationship between you and us, and does not create any duty of care owed to you in respect of advice.
A professional relationship with us is established only when we and you have agreed the scope of work in a signed written engagement (for example, an engagement letter or agreement) and we have confirmed in writing that we have accepted the engagement. Until that occurs, you are not our client, no work has been undertaken for you, and you must not assume that any information is advice given to you.
3. Accuracy and currency of information
We try to ensure that information on the Website is accurate at the time it is published. However:
- Taxation, superannuation and accounting laws, rates, thresholds, rulings and Australian Taxation Office (ATO) administrative practices change frequently, and content may become out of date.
- Content may contain errors, omissions or simplifications, and may not reflect the most recent changes in the law or your specific situation.
- We do not warrant or guarantee that any information on the Website or provided by the Chatbot is accurate, current, complete, reliable or suitable for any purpose.
You should not rely on any information without verifying it with us under a formal engagement, with the ATO (https://www.ato.gov.au), or with another appropriately qualified professional. Where there is any inconsistency between content on the Website and the relevant legislation, ruling or ATO guidance, the legislation, ruling or ATO guidance prevails.
4. AI chatbot disclaimer
If the Website makes a Chatbot or automated assistant available, the following applies in addition to the rest of this Disclaimer:
- It is an automated assistant. The Chatbot is an automated, artificial-intelligence tool. It is not a registered tax agent, accountant, financial adviser or lawyer, and it does not provide a tax agent service or any professional advice.
- It may be inaccurate. The Chatbot may produce errors, may generate information that is incomplete, outdated, misleading or incorrect, and may misunderstand your question. Its responses are general information only and must not be relied on as advice.
- Always confirm with a human. Do not act on anything the Chatbot tells you without confirming it with one of our registered professionals under a formal engagement, or with another appropriately qualified adviser.
- Do not enter sensitive data. Do not enter your tax file number (TFN), bank account details, passwords, government identifiers, or other sensitive personal or financial information into the Chatbot or any Website form. The Website and Chatbot are not intended for the exchange of sensitive information; please use the secure channel we provide for that purpose — the Fedix Client Portal, which encrypts uploads in transit and at rest and limits access to your engagement team.
- No engagement via the Chatbot. Interacting with the Chatbot does not create a client or engagement relationship (see clause 2), and the Chatbot cannot accept instructions, accept an engagement, or give advice on our behalf.
5. External links and third-party content
The Website may contain links to, or content from, third-party websites, tools or services that we do not control. We provide these for convenience only. We do not endorse, and are not responsible for, the content, accuracy, availability, products, services or privacy practices of any third party. Accessing third-party sites or services is at your own risk and subject to their own terms.
6. No warranty
To the maximum extent permitted by law, the Website and the Chatbot are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Website or Chatbot will be uninterrupted, secure, error-free, free of viruses or other harmful components, or that any defects will be corrected.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss, damage, cost or expense (including direct, indirect, incidental, special or consequential loss, and loss of profit, data, goodwill or opportunity) arising out of or in connection with your access to, use of, or reliance on the Website, the Chatbot, or any content or response made available through them, whether in contract, tort (including negligence), statute or otherwise. You use the Website and the Chatbot, and rely on any content, at your own risk.
Australian Consumer Law -- non-excludable rights are preserved. Nothing in this Disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy that applies to you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law, to the extent that it cannot lawfully be excluded, restricted or modified. The Australian Competition and Consumer Commission confirms that “the basic rights covered by consumer guarantees can’t be taken away by anything a business says or does” and that consumer guarantees “are automatic and can’t be taken away”. Accordingly, the limitations and exclusions in this Disclaimer apply only so far as the law allows.
Where a consumer guarantee or other non-excludable right applies and we are permitted by law to limit our liability for failing to comply with it, our liability is limited (at our option, to the extent the law allows) to: in the case of services, resupplying the services or paying the cost of having the services resupplied; and in the case of goods, replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.
8. No misleading conduct intended
We aim to ensure that representations on the Website are accurate, truthful and based on reasonable grounds, consistent with the Australian Consumer Law and our professional obligations. The ACCC states that “any information or claim that a business provides about its products or services must be accurate, truthful and based on reasonable grounds” and that “it makes no difference whether a business intends to mislead or not”. Any testimonials or reviews displayed on the Website (if any) are genuine and reflect the actual experience and opinion of the person who provided them. If you consider any content to be inaccurate or misleading, please contact us so we can review it.
9. Professional indemnity
As a registered tax agent, we hold professional indemnity insurance that meets the Tax Practitioners Board’s requirements, in connection with the professional services we provide under engagement. This insurance relates to our engaged professional services and does not extend to, or imply any warranty in respect of, the general information on the Website or the Chatbot. 10. Reliance at your own risk
Any reliance you place on the Website or the Chatbot is strictly at your own risk. You are responsible for evaluating the accuracy, completeness and usefulness of any information and for obtaining your own professional advice before making any decision.
11. Changes to this Disclaimer
We may update this Disclaimer at any time by posting the updated version on the Website. The version published on the Website at the time you access it applies to your use. The date this Disclaimer was last reviewed appears at the top of this page.
12. Severability
If any part of this Disclaimer is found to be invalid, illegal or unenforceable, that part is to be read down to the minimum extent necessary, or severed, without affecting the validity or enforceability of the remaining provisions, which continue in full force.
13. No waiver
No failure or delay by us in exercising any right under this Disclaimer operates as a waiver of that right, and no single or partial exercise of any right prevents any further exercise of it or of any other right.
14. Entire understanding
This Disclaimer, together with our Terms of Use and Privacy Policy, sets out the entire basis on which we make the Website and the Chatbot available to you, and supersedes any prior representation or understanding about that subject matter. It does not affect the terms of any separate written engagement you enter into with us for professional services.
15. Governing law
This Disclaimer is governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State and the courts competent to hear appeals from them.
